TERMS AND CONDITIONS OF THE ONLINE STORE
Definitions
The terms used in these Terms and Conditions are defined as:
1. Customer – a natural person, legal entity, or organizational unit without legal personality, which, under specific regulations, is granted legal capacity and places an Order in the Store.
2. Consumer – in accordance with Article 22[1] of the Civil Code, refers to a natural person who performs a legal act with an entrepreneur that is not directly related to their business or professional activity.
3. Civil Code– the Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended).
4. Terms and Conditions – these Terms and Conditions specifying the general terms of sale and the rules for providing electronic services within the Sztuki online store.
5. Online Store (Store) – the online service available at https://sztuki.waw.pl, through which the Client can, among other things, place Orders.
6. Goods - products presented in the Online Store.
7. Sales agreement - a sales agreement for Goods within the meaning of the Civil Code, concluded between Sztuki and the Client, made through the online service of the Store.
8. Consumer Rights Act - the Consumer Rights Act of May 30, 2014 (Journal of Laws 2014, item 827).
9. Act on Providing Services by Electronic Means - the Act of July 18, 2002, on Providing Services by Electronic Means (Journal of Laws No. 144, item 1204, as amended).
10. Order – an expression of the Client's intent directly aimed at concluding the Sales Agreement, specifying in particular the type and quantity of Goods.
II. General Provisions
1. Niniejszy Regulamin określa zasady korzystania ze sklepu internetowego dostępnego pod adresem https://sztuki.waw.pl.
2. Niniejszy Regulamin jest regulaminem, o którym mowa w art. 8 Ustawy o świadczeniu usług drogą elektroniczną.
3. Sklep internetowy Sztuki, działający pod adresem https://sztuki.waw.pl, prowadzony jest przez Sztuki Julita Zembrowska, ul. Smulikowskiego 9/13, 00-348, Warszawa, NIP: 9512115432. Działalność gospodarcza jest zarejestrowana w Centralnej Ewidencji i Informacji o Działalności Gospodarczej (CEIDG), prowadzonej przez Ministra właściwego do spraw gospodarki.

4. Niniejszy Regulamin określa w szczególności:
– zasady dokonywania rejestracji i korzystania z konta w ramach sklepu internetowego;
– warunki i zasady składania drogą elektroniczną Zamówień w ramach sklepu internetowego;
– zasady zawierania Umów sprzedaży z wykorzystaniem usług świadczonych w ramach Sklepu Internetowego.
5. Korzystanie ze sklepu internetowego jest możliwe pod warunkiem spełnienia przez system teleinformatyczny, z którego korzysta Klient, następujących minimalnych wymagań technicznych: Połączenie z Internetem. Przeglądarka internetowa z włączoną obsługą JavaScript. Minimalna rozdzielczość ekranu 320 x 480 px.
6. W celu korzystania ze sklepu internetowego Klient powinien we własnym zakresie uzyskać dostęp do stanowiska komputerowego lub urządzenia końcowego, z dostępem do Internetu.
7. Zgodnie z obowiązującymi przepisami prawa Sztuki zastrzegają sobie możliwość ograniczenia świadczenia usług za pośrednictwem Sklepu internetowego do osób, które ukończyły wiek 18 lat. W takim przypadku potencjalni Klienci zostaną o powyższym powiadomieni.
8. Klienci mogą uzyskać dostęp do niniejszego Regulaminu w każdym czasie za pośrednictwem odsyłacza zamieszczonego na stronie głównej serwisu https://sztuki.waw.pl oraz pobrać go i sporządzić jego wydruk.
III. Rules for Using the Online Store
1. Registration within the Online Store is optional. The Client can place an order without registering in the Store, after reviewing and accepting these Terms and Conditions. Registration is done by completing and accepting the registration form provided on one of the Store's pages. A condition for registration is agreeing to the content of the Terms and Conditions and providing mandatory personal data.

Sztuki may revoke the Client's right to use the Online Store and may also restrict their access to parts or all of the Online Store's resources, with immediate effect, in the event of a breach of the Terms and Conditions by the Client, particularly if the Client:
– provided false, inaccurate or outdated information during registration in the online store, which is misleading or infringes on the rights of third parties,
– committed a violation of third parties' personal rights through the online store, particularly the personal rights of other clients of the online store,
– engages in other behaviors deemed by Sztuki as inconsistent with applicable laws or general principles of internet use, or that damage the reputation of Sztuki.
2. To ensure the security of communication and data transmission related to the services provided on the Website, the Online Store takes technical and organizational measures appropriate to the level of risk associated with the services provided. This includes measures to prevent unauthorized access to and modification of personal data transmitted over the Internet.
3. The Client is particularly obligated to:
– use the Online Store in accordance with the laws applicable in the Republic of Poland, the provisions of these Terms and Conditions, and general principles of internet use.
– not providing or transmitting content prohibited by law, such as content that promotes violence, defames, or infringes on the personal rights and other rights of third parties,
– using the Online Store in a manner that does not disrupt its operation, particularly by not using specific software or devices that could interfere.
– not engaging in activities such as sending or placing unsolicited commercial information (spam) within the Online Store,
– using the Online Store in a manner that does not inconvenience other clients or Sztuki,
– using all content posted within the Online Store solely for personal use,
IV. Procedure for Concluding the Sales Agreement
1. To conclude a Sales Agreement through the Online Store, you need to visit the website https://sztuki.waw.pl and select the Goods by following the subsequent technical steps based on the messages displayed to the Client and the information available on the site.
2. The selection of Goods by the Client is made by adding them to the cart.
3. During the ordering process—up until the moment the button confirming the order is pressed—the Client has the option to modify the entered data and selected Goods. To do this, the Client should follow the messages displayed and the information available on the site.
4. After the Client using the Online Store provides all necessary information, a summary of the order will be displayed. The order summary will include, among other things, a description of the selected goods or services, the total price, and any other applicable costs.
5. To submit the Order, it is necessary to accept the content of the Terms and Conditions, provide the mandatory personal data, and press the button confirming the submission of the Order.
6. Information about the Goods provided on the Store's website constitutes an offer within the meaning of Article 66 of the Civil Code.
7. The submission of an Order by the Client constitutes a declaration of intent to enter into a Sales Agreement with Sztuki, in accordance with the Terms and Conditions. The Agreement is considered concluded at the moment the Client's Order is received by the Online Store's information system, provided the Order complies with the Terms and Conditions.
8. After the Agreement is concluded, the Client will receive an email containing confirmation of all essential elements of the Order.
9. The Sales Agreement is concluded in Polish, in accordance with the content of the Terms and Conditions.
10. Clients can access these Terms and Conditions at any time via the link on the homepage of the service https://sztuki.waw.pl and download and print them.
The preservation, security, and provision of order data and the General Terms (Sales Terms and Conditions) are done via email. Previous orders can be viewed within your account after logging in.
V Delivery
1. Delivery of Goods is limited to the territory of the Republic of Poland and is made to the address specified by the Client during the ordering process.
Delivery of the ordered Goods is carried out via:
– A courier company
There is an option for personal pickup of the ordered Goods at our store: Sztuki, located at ul. Chmielna 12 in Warsaw, from Tuesday to Saturday between 2:00 PM and 7:00 PM, except on public holidays. When picking up the ordered Goods at the store, you may pay in cash.
2. The delivery cost depends on the contents of the shipment. More information is available in the section at sztuki.waw.pl/dostawa. Additionally, delivery costs will be specified during the order placement process.
3. The order processing time is 1-5 business days. If the waiting time for the product is longer, this information will be provided on the product page. In addition, the delivery time via courier company (usually 1-2 business days) should be added, which can be up to a maximum of 15 business days.
4. Damage to Goods occurring during delivery.
In the case of a consumer distance purchase, our Store always bears the risk of accidental damage or loss of Goods during transport. If the Goods are delivered with obvious damage incurred during transport, we kindly ask you to report such damage to the carrier as soon as possible and to contact us. Delays in reporting such complaints or making contact have no impact on your statutory claims and their satisfaction, particularly your rights under statutory warranty for defects (Section VIII of the Terms and Conditions). Prompt reporting of any damage observed during transport helps us in pursuing our own claims against the carrier or transport insurer.
VI. Prices and Payment Methods
1. The prices of Goods are stated in Polish złoty and include all components, including customs duties and any other charges.
2. The Client has the option to pay the price using:

–cash on delivery (additional fee of 4 PLN)
-tpay.com (payment card, credit card, BLIK, bank transfer)
VII. Right of Withdrawal from the Agreement
A Client who has entered into a distance contract, i.e., made a purchase on our online store, may withdraw from the sales agreement within 14 days without providing a reason. The Client can withdraw from the sales agreement by submitting a declaration of withdrawal. This declaration can be made in writing to the address: Sztuki, ul. Chmielna 12, 00-020 Warsaw, or via email to: sklep@sztuki.waw.pl. To meet the deadline, it is sufficient to send the declaration before the deadline expires. The Client is required to return the Goods to us without undue delay, but no later than within 14 days.
VIII. Complaints Regarding Goods
Applies to Clients who are Consumers:
We are obligated to deliver Goods free from defects. Statutory liability for defects in sold items (warranty for defects) applies as specified in Articles 556 and 556[1]-556[3] and subsequent articles of the Civil Code.
Complaints can be submitted:

When submitting a complaint, it is recommended to (1) provide information about the subject of the complaint, including the type and date of the defect; (2) specify the request regarding how to remedy the defect (replacement of the goods with new ones, repair of the goods, price reduction, withdrawal from the contract – if the defect is significant); and (3) provide contact details of the complainant – this will facilitate and expedite the review of the complaint by the Store. The recommendations stated in the previous sentence are only non-binding guidelines and do not affect the effectiveness of complaints submitted without the recommended information.
IX. Complaints Regarding the Provision of Electronic Services
1. Sztuki takes measures to ensure the proper functioning of the online store to the best of its technical knowledge and commits to addressing any issues reported by customers within a reasonable timeframe.
2. The Client can notify us of any irregularities or interruptions in the operation of the online store. Please report any issues related to the functioning of the store electronically to: sklep@sztuki.waw.pl.
3. In a complaint concerning irregularities related to the operation of the online store, please specify the type and date of the irregularities.
4. We commit to addressing the complaint promptly, no later than 14 days from the date it was submitted.
X. Alternative Dispute Resolution and Claims Handling
1. We would like to inform you that there are options available for out-of-court dispute resolution and claims handling. Participation in these methods is voluntary and can only take place if both parties to the dispute agree to it.
– The consumer can request the initiation of proceedings for out-of-court resolution of consumer disputes related to the concluded sales contract to the Trade Inspection, in accordance with Article 36 of the Act of December 15, 2000, on Trade Inspection (Journal of Laws 2001 No. 4, item 25, as amended).
– The consumer may also file a request for the resolution of a dispute concerning the concluded sales contract with a permanent arbitration court operating at the relevant regional inspectorate of the Trade Inspection, in accordance with Article 37 of the Act of December 15, 2000, on Trade Inspection (Journal of Laws 2001 No. 4, item 25, as amended).
– The European Commission also provides an online platform for resolving disputes between consumers and entrepreneurs (ODR platform). It is available at: http://ec.europa.eu/consumers/odr/.

Detailed information regarding the resolution of consumer disputes, including the possibility for consumers to use out-of-court methods for handling complaints and seeking redress, as well as the rules for accessing these procedures, is available at the offices and on the websites of the provincial inspectorates of the Trade Inspection, and at the following website: https://uokik.gov.pl/spory_konsumenckie.php.
XI. Final Provisions
The competent court for resolving disputes with Consumers is the court having jurisdiction based on the applicable provisions of the Code of Civil Procedure.
2. The resolution of any disputes arising between Sztuki and a Client who is not a Consumer will be submitted to the court competent due to our seat.
3. In matters not regulated by these Terms and Conditions, the provisions of applicable law shall apply, in particular the provisions of the Act of April 23, 1964, the Civil Code (consolidated text Dz. U. of 2014, item 121, as amended) and the Act of May 30, 2014, on Consumer Rights (Dz. U. of 2014, item 827). In the event of any discrepancies between these Terms and Conditions and the rights of Clients and provisions resulting from universally applicable regulations, the universally applicable provisions of Polish law shall apply.
